ダッソー・システムズ個人情報保護方針

ダッソー・システムズは、3DEXPERIENCEカンパニーとして、デジタル時代において利害関係者にとってデータ保護が重要な主題であることを常に認識しており、個人データの取り扱いに伴う責任を理解しています。本個人情報保護方針では、本個人情報保護方針で言及されているウェブサイトやモバイルアプリ、ブランドのソーシャルメディアページ（以下「サイト」と称す）や、3DS がお客様に提供する製品・サービス（以下「サービス」と称す）との関係で、個人データの収集、使用、保管またはその他の処理に関する、Dassault Systèmes S.E.およびその関係会社（以下、総称して「3DS」と称す）による個人情報保護のルールについて説明しています。ご自分の個人データに関して、お客様個人がご利用いただける権利や選択肢について、解説するものです。

なお、本個人情報保護方針の末尾に記載されている補足事項が適用される場合がありますので、ご注意ください。

本個人情報保護方針は、3DSがデータの管理者、すなわち、オンライン（3DS のサイトに関連するものを含む）またはオフラインで、どのような個人データをどのような目的で収集するかを決定する当事者として処理する個人データに適用されます。

本個人情報保護方針は以下には適用されません

• 3DS の従業員および採用希望者に関する個人データ。
• 適用される契約書の定めに従って、お客様またはその他の第三者に代わって 3DS が処理する個人データ。

本個人情報保護方針は、以下の情報を提供します。

• 3DS が収集する可能性のあるお客様の個人データの種類（詳細な連絡先情報など）
• 個人データの収集方法
• お客様の個人データを処理する目的と法的根拠（例： 法律を遵守するため、お客様の同意を得てマーケティングを行うため）
• 個人データに関するお客様の権利と選択肢
• 国または地域によっては、3DS による個人データの処理に関連して、法的権利が認められている場合があります。これには、データへのアクセス、修正、削除、移転を求める権利、個人データの処理に異議を申し立てる権利などが含まれます。お住まいの場所に関わりなく、3DS は、マーケティングに関連する弊社からの連絡をオプトアウトしたいとするお客様のご要望を尊重いたします。
• お問い合わせ方法

お客様の利便性のために、3DSのサイトには、3DSが所有または管理していない他のウェブサイトまたはアプリへのハイパーリンクが掲載されることがあります。本個人情報保護方針は、これらのサイトには適用されず、3DSは、第三者のウェブサイトのコンテンツおよびそれのサイトが収集する個人データについて責任を負いません。ご自分がアクセスする他の Web サイトや使用するサービスの個人情報保護方針をお読みになることを、3DS では推奨いたしております。

個人データとは、特定の個人と識別された、もしくは識別が可能な個人に関わるあらゆる情報を意味します。識別可能な個人とは、特に、自然人に付された番号や当該人物に固有の1つないし複数の属性情報を、直接的にまたは間接的に照合することによって、特定の個人としての識別が可能になる個人のことです。

いかなる場合も、3DS が処理する個人データは、本個人情報保護方針に記載されている目的に必要なデータに限ります。

以下に詳述する目的に応じて、3DSが処理する個人データには以下のものが含まれます:

• 姓名、住所、電子メールアドレス、電話番号、役職などの個人的なまたはビジネス上の連絡先情報
• ユーザーID、ログイン名、パスワード、プロフィール写真、大学名、学位、資格、受講したコース、組織の種類(会社、学校等)、組織名、組織の規模、部署、業種、業種の下位分類等のプロフィール情報
• 3DSのサイトを通じたものを含む購入、イベントへの登録、請求データ(クレジットカード情報、銀行口座情報など)に関する詳細な取引情報、署名
• 健康に関するデータ： 3DSが主催するイベントに参加される場合、障害や食事に関する特別な要件をお持ちの方を特定して配慮する目的で健康に関する情報の提供を求められる場合や、イベント中に処理が必要なその他の個人データの提供を求められる場合があります。
• 該当する場合、以下に記載するクッキーを通じて取得されたデータおよび、3DSマーケティングプリファレンスセンターを通じて取得されたデータを含む、お客様が3DSのサービスをどのように利用しているかに関する利用状況データ（IPアドレスおよびMACアドレス、ログ等）。

かかる個人データを、以下の方法により、3DS が収集する場合があります。

• 本サービスを通じて、またはその他の方法で、お客様から直接収集
• 自動的に収集
• 以下の第三者から収集
  • • - お客様の雇用主、学校、お客様が所属するその他の組織
    • - お客様の個人データを 3DS と共有するようお客様が指示した第三者
    • - 公開データベース

必須と規定されている個人データの提供は任意ですが、お客様に 3DS のサービスを提供するためには不可欠です。

3DS のサービスは、適用されるデータ保護法の下で未成年とみなされるお子さま向けには設計されておりませんので、ご注意ください。未成年者は、親または保護者から事前に許可を得ている場合を除き、3DS のサービスを利用することはできません。お子さまから個人データを収集したことが判明した場合、3DS は、その情報を可及的速やかに削除いたします

3DS がお客様の個人データを処理する目的は、以下に説明するように法的根拠ごとに再分類されます。 特定のデータプライバシー法に従ってそのような法的根拠が適用されない場合でも、いずれにしても、3DS は、法律で許されている範囲内でのみ、お客様の個人データを利用いたします

お客様の同意を得たうえで

• お客様と連絡を取り合うため。これには以下が含まれます。お客様が 3DS サービスに関連する情報をお求めのとき、3DS サイトに登録されるとき、調査に参加されるとき、3DS が特定のアクションを実行することを許可するとき （例： 3DS サイトにお客様の声やお勧めを投稿するなど）を含め、より一般的に言えば 3DS との連絡を管理し、マーケティング活動を行うため。
• お客様のニーズ・関心を把握し、最適なサービスを提供するため。
• お客様が3DSのサイトをパーソナライズされた形でインタラクティブに利用し、そのすべての機能を利用できるようにするため。
• 3DEXPERIENCE Platformを含む3DSのサイトの他のユーザーと3DSサービスに関するアイデアやその他の情報を交換する際に、お客様のプロフィールに関連する特定の個人情報を表示できるようにするため。

3DS サービス提供に関する契約を取り交わすため

• お客様が以下のことをできるようにするためイベント、セミナー、ウェビナーへの登録、コンテストへの参加（登録したり参加したりしたイベントの追跡と管理、3DS コミュニティフォーラムへの登録を含む）。3DS サービスにアクセスするためのアカウントを作成し、「3D EXPERIENCE ID」などのユーザー ID を取得するため。
• 3DS がお客様との業務用連絡を管理できるようにするため（販売機会、商用オファー、購入、契約、注文、請求書、配送、3DS サービスのユーザーにとって重要な情報を含むかまたは 3DS サービスやプロフェッショナルサービスのセキュリティに関連するサポート）
• 3DSのサービスに関するお客様のトレーニングや認証を管理するため。これには、お客様にこれらの情報を提供するために、お客様の学習進捗状況を追跡することが含まれます。
• 本サービスを運用、維持、管理、改善するため。

以下の正当な利益を守るため:

3DSは、正当な利益に基づく目的のためにお客様の個人データを処理する前に、お客様への潜在的な影響(ポジティブなものおよびネガティブなもの)およびお客様の権利を考慮し、バランスを取ります。3DSは、3DSがお客様の同意を得ている場合、または法律で義務付けられている場合もしくは許可されている場合を除き、お客様への影響がお客様の個人データを処理することの正当な利益を上回る状況においては、お客様の個人データを使用しません。

• お客様の体験を向上するため、お客様のニーズや関心をよりよく理解し、設定の記録を含め 3DS サービスにおけるお客様の体験をパーソナライズするため。
• 3DSサービスまたは3DSサイトを提供、維持および変更するため
• お客様が既に3DSのサービスを利用している場合に、類似の商品・製品のマーケティング活動に関連する情報を提供するため。
• お客様が 3DS の見込み客、顧客、サプライヤー、またはビジネス関係者 に代わって行動する際に、3DS が業務連絡を管理できるようにするため（販売機会、商用オファー、購入、契約、注文、請求書、配送、3DS サービスのユーザーにとって重要な情報を含むかまたは 3DS サービスやプロフェッショナルサービスのセキュリティに関連するサポートと併せて）そしてトレーニング。
• 3DSの著作権侵害対策およびコンプライアンス・プログラム を管理するため。;
• 分析、コンプライアンス、不正防止および安全のために匿名化されたデータを作成するため。
• 詐欺行為、有害行為、無許可行為、非倫理的行為、違法行為を防止、調査、抑止するため、および、3DS サイバーセキュリティプログラムの枠内で安全を確保するため。

3DSは、お客様の個人データを、追加の関連する公開情報またはその他の処理活動を通じて収集した個人データと組み合わせることがあります。

法令遵守のため

• 該当する場合、自動チェックを介して, コンプライアンスに関する法令に関連する 3DS の法的義務を管理するため。これには、腐敗防止法、適用される輸出法および規制、ならびに米国輸出管理規則（EAR）、外国資産管理局（OFAC）の特別指定国民制裁、欧州連合理事会規則などの世界的な制裁プログラムが含まれますが、これらに限定されるものではありません； 
• お客様の支払いデータを第三者の支払プロバイダーに預けるため。
• 政府当局からの召喚や要請に対応するなど、合法的な要求や法的手続きを遵守するため。詳しくは以下に述べます。

3DSは、お客様の個人データを必要以上に長期にわたって保存することはなく、上記に定める目的を果たすために必要な期間のみ保存します。保存期間は、データの種類や処理の内容によって異なる場合があります。個人データの適切な保存期間を決定するために、3DSは、個人データの量、性質および機微、お客様の個人データが不正に使用または開示された場合に生じる潜在的なリスク、3DSがお客様の個人データを処理する目的および3DSが他の手段で当該目的を達成できるか否か、並びに適用される法的要件を考慮します。

• お客様が同意された場合、お客様が同意を撤回されるまで。
• 3DSがお客様またはお客様の雇用者と契約を締結している場合、当該契約が有効である限り、および適用される現地の出訴期間を満たす限り。
• 3DSがお客様の個人データを使用することに正当な利益を有する場合、お客様の個人データの公正な処理を確保するために適切な期間、またはお客様が3DSによるお客様の個人データの使用に異議を唱えるまで。但し、お客様の異議を申し立てる利益に優先する処理を継続するための、または、法的請求の確立、行使、防御を行うための、3DSにとってやむを得ない法的根拠がある場合に限ります。
• 3DSが法的義務を遵守する必要がある場合、保存期間は、適用される法律に従って決定されます。
• お客様の個人データが法的請求を主張または防御するために必要とされる場合、3DSはお客様の個人データを、関連する保存期間が終了するまで、またはそのような法的請求が解決されるまで保持します。

保存期間が終了すると、お客様の個人データは、データ保護基準に沿った手順や方法により、削除または匿名化されます。

3DSは、情報の貸し出しや販売は行いませんが、特定のビジネス目的のために、必要なお客様の個人データを以下のカテゴリーの組織と共有することがあります。

• 3DSグループ内。3DSグループは、お客様に迅速かつ積極的なサービスを提供するために、米州、アジアおよび欧州に所在する世界的な多層組織です。このようなグローバル化した状況において、3DSは、たとえば、本個人情報保護方針と合致する目的のため（例： カスタマーサポートを提供するため）、お客様の個人データを共有する必要が生じることがあります。
• 3DS の信頼できる関係者とともに
  • • - イベントやマーケティングのスポンサー:3DSは、3DSがイベントやマーケティングプロモーションを主催する際に、3DSの販売代理店等の信頼できるスポンサーとお客様の個人データを共有することがあります。お客様がイベントに登録する場合、3DSは、イベントに関する連絡や意見交換を目的として、お客様の氏名、会社名、電子メールアドレスを同じイベントの他の参加者やスポンサーと共有することがあります。
    • - 3DSのビジネスパートナー(https://www.3ds.com/ja/partners/ https://www.solidworks.com/ja/how-to-buy/find-solidworks-reseller/) :3DSは、お客様またはお客様の雇用者に適切なオファーまたはサービスを提供するために、お客様を担当する販売代理店等の3DSのビジネスパートナーとお客様の個人データを共有することがあります。
    • - 3DS に代わって活動する第三者： 3DS は、3DS に代わってサービスを管理・提供させる目的で、必要に応じて、第三者の企業・個人と契約し、第三者から3DS 向けにサービスを提供する過程で、お客様の個人データを共有する場合があります。（トレーニング、カスタマーサポート、ホスティング、支払い、3DS サービス、電子メール配信、データベース管理サービスを購入できるようにするためのサービスなど）。これらの第三者は、3DS の指示に従い、本個人情報保護方針と合致する方法でのみ、お客様の個人データを利用することができ、その他の目的でお客様の個人データを利用または開示することは禁止されています。

• 第三者が適用法を遵守している場合、3DS は、適用法に応じて、お客様の個人データの一部を、政府または法執行機関の職員または民間団体に開示する場合があります。これには以下のケースがあてはまります。(a) かかる情報開示が法的手続き（令状、召喚、またはその他の裁判所からの命令など）を遵守するために合理的に必要であると、3DS が誠実に信じる場合。(b) 3DS サービスに適用される条件を執行するため。(c) 3DS、または3DS のお客様、または公共の権利・財産・安全を保護するため。(d) 詐欺行為、有害行為、無許可行為、非倫理的行為、違法行為を防止、調査、抑止するため。3DS は、要請内容が適用法に従ったものであることを確認するため、要請内容を検討いたします。要請で、あまりに多くの情報が求められている場合、3DS はこれを絞り込むよう努め、可能であれば、情報提供自体に異議を申し立てます。
• 3DS の法的利益や業務上の利益に貢献する第三者や、これを保護する第三者に対して： 合併、統合、買収、再編成、資産売却などの商取引（または潜在的な商取引）に関連して、または、破産、支配権変更、3DS の全部または一部の清算が発生した場合、3DS は、その事業や資産の一部または全部を売却、譲渡、またはその他の方法で共有する場合があります。これにはお客様の個人データも含まれます。この場合、3DS は、受領者が本個人情報保護方針を遵守するよう求め、適切な努力を行います。

3DS サイトが所在する国とは別の国に居住し、3DS サイトにアクセスして、これを継続的に利用することは、他国に個人データを移転することに同意したことになりますのでご注意ください。当該他国においては、プライバシー法があっても、お住まいの国と同レベルの保護を受けられない場合があります。

3DS は、世界規模で多重構造を展開する企業です。このため、アフリカ、アジア、ヨーロッパ、南北アメリカの、ある国や地域から、別の国や地域に向けて、個人データを移転する場合があります。たとえば 3DS がお客様向けに、トレーニング、カスタマーサポート、ホスティングサービスなどのサービスを提供する際に、こうしたデータ移転を行うことがあります。

お住まいの国の当局（欧州委員会など）により、適切なレベルの個人データ保護が行われていないと見なされている国に、お客様の個人データを移転する場合、お住まいの国の当局により、個人データを適切に保護できると認められた保護手段を講じたうえで、データ移転を行います。これには、欧州委員会の定める標準契約条項、移転に関するインフォームドコンセント、その他の関連メカニズムが該当します。

米国の3DS関連会社の一部は、米国商務省が定める、EU-米国データ・プライバシー・フレームワーク（EU-米国DPF）、EU-米国DPFの英国拡張版、およびスイス-米国データ・プライバシー・フレームワーク（スイス-米国DPF）の認定を受けています。詳細については、Dassault Systèmes Americas Corp.およびDassault Systèmes SolidWorks Corporationのプライバシーポリシーをこちらで、Medidataのプライバシーポリシーをこちらでご覧ください。

個人データを移転するにあたり、3DS が運用しているメカニズムに関する詳細情報が必要な場合は、お問い合わせください。

適用されるデータ保護法に応じて、お客様は、ご自身の個人データに関して、以下の権利の一部または全部を有する場合があります。

• お客様の個人データにアクセスすること。
• 3DSが保管しているお客様の個人データのコピーを入手すること。
• お客様の個人データを修正、補完、更新または消去することを求めること。
• 処理を制限すること。
• お客様の個人データの特定の処理が正当な利益に基づくものである場合に、当該処理に対して異議を唱えること。
• データポータビリティ。
• お客様の個人データの処理がお客様の同意に基づいている場合、お客様はいつでもその同意を撤回する権利を有します。（例： マーケティング情報のオプトアウトや登録解除について）。

請求の範囲に応じて、また適用される法律で認められている場合、3DSは、当該請求に関連して発生した費用を賄うために合理的な手数料を請求することがあります。3DSは、適用される法律および規制に従い限定的な状況において、または、3DSの法的根拠がお客様のプライバシーに関する正当な利益を上回る場合には、お客様の個人データへのアクセスを拒否することができます。

3DS は、お客様の身元を確認するため、または、お客様のご要望に対応するため、一定の情報提供をお願いする場合があります。適用法が求めるところ、または、適用法が認めるところに従って、3DS がお客様からのご要望をお断りする場合もありますが、いずれにせよ、3DS は法律の範囲内において自社の立場をご説明いたします。

3DSは、お客様の個人データを、送信中および保存中の紛失、誤用、不正アクセス、開示、改ざんおよび破棄から保護するために、適切な技術的・組織的措置を講じています。3DSはお客様の個人データの保護に努めているものの、インターネットに関連する不可避のリスクを考慮すると、3DSはあらゆる漏洩に対して完全な保護を保証することはできません。

お客様の個人データへの不正アクセスを防ぐためには、お客様自身も十分注意されることが重要です。お客様は、お客様のアカウントで表示されるお客様のパスワードおよび情報の秘密を保持することについて、責任を負います。したがって、お客様がコンピューターを共同使用している場合、セッションを終えるときに必ずログアウトしていただく必要があります。

3DSサービスのお客様の閲覧エクスペリエンスを向上させるために、3DSは、お客様の個人データを処理する可能性のあるクッキーまたはその他の類似技術を使用しています。

サービスによって、3DSは異なる種類のクッキーを使用します。

• 厳密に必要なクッキーは常に使用されます。これらのクッキーはお客様が3DSのサービスを適切にご利用になるために不可欠であり、オフにすることはできません。たとえば、これらのクッキーは、お客様の個人設定(言語の選択、サービスの提示、ショッピングカートの保存)を保存するために使用されます。

cookieの無効化 

お客様は、Cookie バナーを使用するか、サイトのフッターにある [Cookie の設定を管理する] リンクをクリックすることで、機能性 Cookie や広告 Cookie をいつでも削除・拒否することができます。ただし、特定の Cookie を受け入れない場合、サービスの一部機能が正しく機能せず、ご利用の際にご不便を感じる場合があります。たとえば、3DS がお手元のパソコンやモバイルデバイスを認識できない場合があり、3DS サイトにアクセスするたびにログインする必要が生じることがあります。広告 Cookie の削除を選択した場合、広告は引き続き表示されるものの、お客様の興味関心とは関係ないものになります。

• 本個人情報保護方針についてご質問がある場合。
• お客様の個人データへのアクセスまたは上記のお客様の権利に関する問題が発生した場合。
• 3DSがGDPRまたは適用される地域のデータ保護法を遵守していないと思われる場合。
• お客様の個人データの安全性が損なわれている、または悪用されていると信じるに足る理由がある場合。

3DS Global Data Protection Officerに苦情を申し立てる場合、本方針の末尾に記載されている住所に書面を送付するか、上記のフォームを使用して、(フォームで要求される情報に加えて、権利の種類に応じて)当該処理の名称または参照、および3DS Global Data Protection Officerが合理的に要求する追加情報を記載した上で、苦情を申し立てる必要があります。

お客様の通常の居住地が欧州連合、リヒテンシュタイン、ノルウェーまたはアイスランドの場合、お客様は現地のデータ保護当局に苦情を申し立てる権利があります。

該当する場合、3DS 地域データ保護担当者までご連絡ください。この連絡先は、以下の国や地域ごとに定められた補足条件に従って、ご利用いただけます。

3DS は、3DS の要件や状況に基づいて、または、適用法や規制の求めに基づいて、任意の時期に、本個人情報保護方針を改正・更新する権利を有します。3DS の個人情報保護のルールに関する最新情報については、このページを定期的に確認することをお勧めいたします。本個人情報保護方針が大幅に改正された場合、3DS は、電子メール、または、お客様に届く可能性が高いと合理的に判断されるその他の手段により、通知する場合があります。これには、3DS サイトに一定の告知を掲載することも含まれます。

本個人情報保護方針の改正は、3DS が新しい条件を掲載した時点、および（または）改正内容がサービスに実装された時点で有効となります。

Depending on where you are living, some additional terms as detailed below may be applicable to you. Where the Privacy Policy refers to “personal data”, it shall be interpreted, as applicable, to mean “personal information” as defined by the applicable data protection law.

With regard to your rights or any concern you may have related to your personal data, in addition to the contact information above, you may also contact the local 3DS Affiliate located in your country by writing to the legal department at the address in the following table:

All payments made in connection with the 3DS Sites are processed through a third party payment service provider to which 3DS or you provide necessary personal data to enable you to purchase 3DS Services. These payment service providers may share your personal data with other services providers (such as verification service, web posting, data analytics) to perform the services in connection with completing a transaction including the processing of payments. 3DS authorizes such payment service provider and related service providers to use and disclose your personal data as long as necessary to perform the foregoing services provided they comply with legal requirements.

“Personal information” means various types of information that are relating to identified or identifiable individuals, as recorded in electronic or other forms, but excluding anonymized information.

Where the Privacy Policy refers to “data controller”, it shall be interpreted, as applicable, to mean “personal information handler” as defined by the applicable data protection law. Please note that, depending on the specific 3DS affiliate in China with which the organization you represent or work for as contracts for the Services or the specific 3DS affiliate that operates the Sites, we identify a specific 3DS affiliate that processes your personal information as the “personal information handler” and it shall process your personal information in accordance with this Dassault Systèmes Privacy Policy (including the China section of the “ADDITIONAL COUNTRY OR REGIONAL TERMS”).

The categories of personal information and purposes of processing by 3DS

3DS may collect the following categories of personal information under the circumstances as below:

• Registration: You may register an account through 3DS Sites and 3DS will collect your personal and business contact information, including your first and last name, universally unique identifier, user ID, email address, postal address, phone number, login, password and country and you may consent to receive marketing communications.
• Purchase of 3DS Services: Transaction information details related to your purchases may be collected by 3DS to perform the deal, including your date of birth, identity documents and proof of address as applicable, billing data (such as credit card details, bank account information).
• Use of 3DS Services: When you request for or use 3DS Services, 3DS will collect your profile information (including user ID, login name and password, profile picture, university, degree, certification and courses taken, organization name, organization size, department, industry and sub-industry sectors, date of birth, job title, phone number, photo, video, audio, professional and academic background, skills, interests), so that 3DS can provide with you 3DS Services to perform our contract. Some information may be optional, as shown on the corresponding profile page.
• Attend 3DS training and/or certification: To manage your training and/or certification on 3DS Services, 3DS will process your learning progress, first and last name, email address, school or organization, country, user name, student or professional ID in order to provide training and/or certification services with you according to our contract.
• Feedback: You may submit feedback in a survey or interact with 3DS through 3DS Sites, where 3DS may collect such information from you, so that 3DS can respond to your feedback.
• Device information: To understand how you use 3DS Services and improve your browsing experience on 3DS Services, 3DS will collect operating and usage data regarding how you use 3DS Sites and Services, including IP and MAC address logs.
• Cookies: 3DS will collect your operation and usage data through cookies when you visit 3DS websites and other apps, in particular in order to review your network environment and constantly improve 3DS Service to make it more user-friendly.

Processing of sensitive personal information: 

“Sensitive personal information” means personal information, the leakage or illegal use of which could easily lead to the infringement of the dignity of an individual, or harm to personal body and prop²erty security, including biometric information, religion, specific identities, medical and health information, financial accounts, personal tracks, as well as the personal information of minors under the age of 14.In this Privacy Policy, specific sensitive personal information collected or processed are summarized as below for your attention.

• Financial personal information (credit card number and expiry date, name and address of the cardholder), to perform contracts of which 3DS is one of the contracting parties and complete your purchase;
• Health information (for the sole purpose of identifying and being considerate of individuals who have disabilities or special dietary requirements throughout events to which you attend); and
• Minor’s personal information: 3DS Services are not designed for minors under the age of 14 in China. If you are under 14, you are not allowed to use 3DS Services, except if you have the prior authorization from your parents or guardians.  If 3DS learns that it has collected personal information from minors without prior authorization from the minor’s parents or guardians, it will delete that information as quickly as possible.

3DS collects your above sensitive personal information to the necessary scope as required to perform the above purposes. 3DS adopts strict protection measures to protect your sensitive personal information.

Marketing communication

If you accept to receive marketing communications and other relevant information from 3DS, 3DS will send you this commercial information, as well as recommendation of contents that you may be interested in via SMS, email or phone. You can unsubscribe from receiving such marketing materials with the help of customer service, or through the instructions in the SMS and email.

Provide personal information to third parties

If 3DS needs to provide your personal information to third parties, 3DS will strictly follow applicable laws and requirements. When it is so required by applicable laws and regulations, 3DS will notify you of details about how 3DS provides your personal information to third parties and obtain your separate consents.

Your Personal Information may be stored on servers in China or overseas.

• Who will receive your personal information:

In addition, if you collaborate or interact with Medidata (which is a 3DS’s affiliate) in the course of business, as part of a global multi-layered organization, Medidata Information Technology (Shanghai) Co., Ltd. may transfer your personal information to Medidata Solutions, Inc., and process and store your personal information in the United States of America. The processing means of the aforesaid overseas data recipient includes collection, processing, storage, and entrusted processing. If you have any questions regarding the cross-border transfer of your personal information or want to exercise your rights, you can contact Medidata Solutions, Inc. through the methods or address provided in the table below:

1. Create and manage company records of existing and potential enterprise customers;
2. Contact existing and potential enterprise customers to engage in business cooperation;

What are your rights and choices

• Withdraw your consent: You may withdraw your consent to processing of your personal information you have provided to 3DS. Certain basic personal information may be required by 3DS to provide you with 3DS Services. If you choose to withdraw your consent for the processing of personal information that is necessary for the 3DS Services, you may not be able to use the related 3DS Services.
• Delete your account: You may ask for the deletion of your account at any time, and 3DS will process your request as soon as practicable after verifying your identity and related authorization.
• File a complaint / request an explanation: You can address a request to 3DS if you have any concern related to the process of your personal information.
• Data portability: If you have satisfied requirements provided by competent government authorities, you can request 3DS transfer your personal information to designated entities, and 3DS will provide the methods of transfer to you.

Processing and sharing of your personal data

3DS is the operator (as defined in Federal Law No. 152-FZ “On Personal Data” of 27 July 2006) of your personal data under this Privacy Policy.

You hereby expressly consent to 3DS instructing third parties listed in this Privacy Policy to process your personal data for the purposes provided herein above. 3DS will be responsible for the processing of your personal data by such third parties.

Processing of health information

If you attend an event organized by 3DS, and you are asked for health information for the purpose of identifying and being considerate of individuals who have disabilities, special dietary requirements, and 3DS will only process such health information upon your separate consent in a written form.

International data transfers and localization of personal data

If you are a Russian Federation resident, 3DS will provide recording, systematization, accumulation, storage, adjustment (update, modification), and extraction of your personal data with the use of databases located in the territory of the Russian Federation. 3DS may transfer your personal data to another country and subsequently store your personal data on additional databases. 3DS may also transfer your personal data to a country that, under the applicable data protection laws, does not provide for the adequate level of protection of data subject’s rights. You hereby expressly consent to such transfer for the purposes of performing 3DS’s obligations under this Privacy Policy.

What are the categories of personal information collected

The categories of personal information 3DS collects are identifiers (e.g. name, address, email, phone number, job title, and transactional information), and internet or other electronic network activity information (e.g. usage information, IP and MAC address, cookie information, and customer feedback).

What are your rights and choices

Depending on your state of residence, you may have the right to request that 3DS discloses to you certain information about 3DS’ collection and use of your personal information. That information may include:

• The categories of personal information 3DS collected about you;
• The categories of sources from which 3DS collected your personal information;
• 3DS’ business or commercial purpose for collecting or sharing your personal information;
• The categories of third parties with whom 3DS shares your personal information, if any;
• A copy of your personal information and a list of recipients, as applicable.

In addition, although 3DS does not and has no plans to sell the personal information of US Residents, you may request that 3DS not sell your personal information in the future by accessing the form referenced in the Privacy Policy above or contacting us using the applicable contact  information listed above.

Only you, or a person, or a business entity registered with the Secretary of State in your state of residency to conduct business in your state of residency that you authorize to act on your behalf, may make a request related to your Personal Information. The request must provide enough information to allow 3DS to 1) reasonably verify you are the person about whom 3DS collected Personal Information or an authorized representative and 2) enable 3DS to properly understand, evaluate, and respond to it. Making such a request does not require you to create an account with us. 3DS will only use personal information provided in a request to verify the requestor's identity or authority to make the request.

You may appeal a decision made by 3DS regarding a  request submitted by you under this Privacy Policy by contacting the 3DS Group Data Protection Officer by the method described above under the Contact Dispute Resolution section or by contacting the DPO for the Americas via the contact information listed above.

Non-discrimination

3DS will not discriminate against you (for example by denying you products or services, charging you a higher price or giving you a different level or quality of service) for exercising any of your state law privacy rights.
